This website is owned and operated by Tao One (“Website Owner”). By accessing the website and any pages thereof, you shall be deemed to have accepted these Terms and Conditions of Use. If you do not agree to these terms and conditions of use, please do not use this website or any pages thereof. These Terms and Conditions of Use may be changed from time to time.All changes will be posted on this page and your use of this website after such changes have been posted will constitute your agreement to the modified Terms and Conditions of Use and all of the changes.


2. Collection and Use of Personal Data

You may be requested to provide personal data such as, but not limited to your name, contact details, NRIC number etc. By providing such data, you will be deemed to have agreed to us disclosing the information provided therein (including, without limitation, your personally identifiable information provided therein) to:-

(a) the Government of the Republic of Singapore;

(b) any other statutory board;

(c) any third party engaged to maintain, repair or enhance this website or otherwise perform services for us; and

(d) affiliated organisations and companies using projectgem.sg for any purpose deemed appropriate by us.


3. Correction of Personal Data and Withdrawal of Consent

If you wish to change any information that you have provided to us or withdraw your consent, please email us at: admin@projectgem.sg. The withdrawal of your consent will constitute the withdrawal from any services or assistance you have received.


4. Protection of Personal Data

The Website Owner take reasonable measures to protect your Personal Data against theft, loss, as well as unauthorised access, copy, use, modification and disclosure.


5. Retention of Personal Data

The Website Owner will retain your personal data only for as long as the purpose(s) for which it is collected and/or a business need exists.


6. Disclaimer of Warranties and Liability

The contents of this website are provided on an “as is” basis with no warranties whatsoever. The Website Owner are not responsible for any loss or damage of any kind caused as a result of, or in connection with, any inaccuracy or error appearing on this website, whether such inaccuracy or error is caused by any act or omission.

To the fullest extent possible, the Website Owner does not warrant and hereby disclaims any warranty:

(a) as to the accuracy, correctness, reliability, timeliness, non-infringement, title, merchantability or fitness for any particular purpose of the contents of this website;

(b) that the contents available through this website or any functions associated therewith will be uninterrupted or error-free, or that defects will be corrected or that this website and the server is and will be free of all viruses and/or other malicious, destructive or corrupting code, agent, program or macro.

The Website Owner reserve all rights, at any time, to deny or restrict access to this website by any particular person; to cease operating this website; or block access to this website from any particular internet address, without ascribing any reasons whatsoever.

This website may contain hyperlinks to websites which are not maintained by the Website Owner. The Website Owner shall not be responsible for the contents of those websites and shall not be liable for any damages or loss arising from access to those websites.

Under no circumstances shall the Website Owner be considered to be associated or affiliated with any trade or service marks, logos, insignia or other devices (not owned by, licensed to, or controlled by the Website Owner) used or appearing on websites to which this website is linked.

Unless expressly permitted in writing by the Website Owner on a prior basis, caching and links to, and the framing of this website or any of its contents are strictly prohibited. The Website Owner reserve the right to impose conditions when permitting any hyperlinking to, or framing of this website or any of its contents.In no circumstances shall the Website Owner be considered to be associated or affiliated in whatever manner with any trade or service marks, logos, insignia or other devices used or appearing on websites that link to this website or any of its contents.

The Website Owner reserve all rights to disable any links to, or frames of any site containing inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topics, names, material or information, or material or information that violates any written law, any applicable intellectual property, proprietary, privacy or publicity rights.The Website Owner reserves the right to disable any links to, or frames of, this website or any of its contents at any time, notwithstanding any prior permission that may have been given by the Website Owner, and disclaims any responsibility for the content available on any other website reached by links to or from this website or any of the contents.

10. Acceptable Site Uses

10(a) Specific Uses – Job Seeker


Job Seeker agrees that he/she shall only use the Site for lawful purposes and genuinely seeking employment. Job Seeker can create an account login via the Site. He/ she agrees to keep the created login name and password with care and shall not disclose them to any other person. Job Seeker shall take sole responsibility for maintaining the confidentiality, safekeeping and security of such login name and password and shall notify Project GEM immediately of any unauthorized use of the same. 

Job Seeker confirms and acknowledges that he/she discloses his/her personal data and all other information to the Advertisers and/or Project GEM of his/her own desire when he/she applies for available job vacancies posted on or through this Site, and/or when Job Seeker uses the Site for purposes of submitting, uploading or posting his/her resume on the Site. By submitting, uploading or posting his/her resume on the Site, Job Seeker is deemed to have given permission to Project GEM to store his/her resume and information or data related thereto in the database of Project GEM (“Database”). Job Seeker may send his/her resume and the related information or data directly to any Advertiser who advertises on or through the Site. Alternatively, Job Seeker may send his/her resume and the related information or data to Project GEM through the Site in reply to any job advertisement. In such event, Job Seeker’s resume and the related information or data will remain active on the Site and be stored in the Database at his/her own risk unless and until he/she chooses to delete them. 

Job Seeker acknowledges and agrees that his/her resume and the related information or data may be accessed by the Advertisers who have subscribed to the services of Project GEM for the sole purpose of recruiting and assessing the suitability of Job Seekers. Project GEM also reserves the right to reject, disapprove or edit any part of the Job Seeker’s resume and the related information or data as it sees appropriate and to erase any personal data which Project GEM reasonably believes that such data are inaccurate, false, illegal, unlawful, infringe copyright / trademark / trade name / trade secret or infringe any other intellectual property rights or invade the privacy of the other having regard to the purpose (including any directly related purpose) for which the data are or are to be used.


Job Seeker acknowledges and agrees to Project GEM’s practice of charging Advertiser a fee for access to the Site, the Database and/or Job Seekers’ resumes, details and the related information or data for the sole purpose of recruiting and assessing the suitability of Job Seekers and subject to the terms herein. Job Seeker also recognizes that he/she shall have no claims to any such fee received by Project GEM.



Project GEM will not release Job Seeker’s personal data to any Advertiser without his/her permission unless required by any authorized institution or obliged under the prevailing laws and regulations. Job Seeker acknowledges and agrees that Project GEM will, if he/she so authorizes, release his/her resume (without his/her personal and contact information and name of his/her current employer) to Advertiser through the use of Project GEM’s search engine or any other means for the sole purpose of enabling Advertiser to recruit and assess the suitability of Job Seekers in relation to any job vacancy. Job Seeker agrees that Project GEM and its associated companies may use his/her personal data (without his/her name, address and other personal identifiable information) for marketing purposes which may be directed to either potential Advertisers, their respective agents or anyone under their employ.



Although Project GEM shall use its reasonable efforts to restrict access to the Database only to the Advertisers and personnel of Project GEM, it does not guarantee that other parties will not, without Project GEM’s consent, gain access to the Database. Job Seeker may disable searching or viewing of his/her resume by the Advertisers at any time. However, Job Seeker acknowledges that the Advertisers and other parties who have otherwise gained access to the Database may have retained a copy of Job Seeker’s resume. Project GEM is not responsible for the retention, use or privacy of resumes in these instances, or for the use or privacy of resumes by any of such parties while the resumes are in the Database. Project GEM will not be responsible or held liable in any way if any Advertiser or other user, in breach of the Terms and Conditions, whether in Singapore or elsewhere, uses the Job Seeker’s personal data, information or materials for any purpose other than for recruiting potential employees. Job Seeker accepts that all personal data, information or materials given to Advertiser or other users, or submitted on or through the Site, are given entirely at his/her own risk.

10(b) Specific Uses – Advertiser


Advertiser agrees that it shall only use the Site for lawful purposes and promoting any job related activities. If Advertiser has elected to also acquire any Banner Ad or EDM (“Project GEM Products”), these Terms and Conditions are to be read in conjunction with Project GEM Products’ specifications, which will be provided on request.

 Upon payment of the service fee to Project GEM or upon acceptance of any free trial promotion offer, Advertiser will be entitled to use the Site to advertise job vacancies and/or to create its own web page on the Site for a predetermined period following agreement of the predetermined service, save and except for free trial promotion offer. Subject to the conditions or requirements from time to time stipulated by Project GEM regarding the access to Job Seeker’s information or data, Advertiser will be entitled to access the Database but agrees that all information or data obtained as a result of such access shall only be used for the sole purpose of recruiting and assessing the suitability of Job Seekers and that such information or data shall not be disclosed to any other parties without the prior consent of the Job Seeker concerned. 

Advertiser acknowledges and agrees that it shall disregard any information or data received from Job Seeker which is irrelevant to recruiting and assessing the suitability of Job Seekers.

 Advertiser shall be solely responsible for the contents of and materials contained in its advertisement and/or web page posted on the Site. Project GEM reserves the right to remove or edit, or require the removal or amendment of, any advertisement or web page as it sees appropriate, or to terminate or suspend the Advertiser’s access and use of the Site and/or services offered on or through the Site, in accordance with the agreement for such services between Advertiser and Project GEM.
 

Project GEM shall have the right to terminate any services offered to any Advertiser and to remove any advertisement and/or web page posted on the Site at Project GEM’s sole discretion, without any compensation or recourse to Advertiser in the event that the relevant Advertiser or the contents of the relevant advertisement and/or web page is or are in breach of any of the provisions herein or any Project GEM Products’ specifications; whereas, in the event that Project GEM decides to remove an advertisement or web page for any reasons not relating to any breach of the provisions herein or any Project GEM Products’ specifications, Project GEM may after deducting the fees charged for the period that the advertisement or web page has been posted on the Site, refund the remaining fees (if any) to the relevant Advertiser. 



From time to time Project GEM may invest in marketing campaigns to promote Advertiser’s brand (including but not limited to Google ads, Yahoo – Bing ads, Baidu ads, Facebook ads, Twitter ads, ad networks, retargeting and other programmatic buying strategies) and acknowledge that such promotion may be outside the domain of Project GEM or its subsidiaries / affiliates. 

Project GEM also reserves the right to change the service fee or institute new charges or fees, from time to time, as it deems appropriate. In the event that any Advertiser fails to pay the service fee or any other fees or charges due to Project GEM, Project GEM reserves the right to suspend or terminate the Advertiser’s web page and/or advertisement and/or right to access the Database, without prejudice to all other rights and remedies available to Project GEM.
